<p>A 73-year-old Lexington woman was jailed Tuesday because police say she left an elderly man under her care in a filthy home.</p>
<p>Julia Polsgrove was charged with one count of <a href="http://www.isaacsandisaacs.com/practice-areas/nursing-home-neglect-and-abuse/" title="Nursing Home Neglect and Abuse">knowingly abusing or neglecting an adult</a> and was being held in the Fayette County Detention Center.</p>
<p>The home on Kilkenny Court was littered with filth and animal feces and was condemned, city spokeswoman Susan Straub said.</p>
<p>&#8220;The house wasn&#8217;t fit to live in,&#8221; said Sherelle Roberts, spokeswoman for the Lexington police. The man at the home was taken to the University of Kentucky Chandler Hospital, she said.</p>
<p>Police, code enforcement and social services workers spent much of Tuesday morning at the home, Roberts said, adding that officials have been aware of problems there for some time. She said the police department&#8217;s special victims section will continue to work with state adult protective services workers on the case.</p>
<p>Fayette District Court records indicate that Polsgrove has been charged with 28 counts of animal-related offenses, such as not having licenses, each year since 2010, but in all but three instances the charges have been dismissed.</p>

				<content:encoded><![CDATA[<p>In the past three days, the intersection of Old Lemons Mill Rd. and McClellan Circle has seen two deadly accidents due to distracted drivers that ran red lights.  </p>
<p>The city of Georgetown typically sees <a href="http://www.isaacsandisaacs.com/practice-areas/auto-accidents/" title="Auto Accidents">two deadly accidents</a> per calendar year, but has <em>already</em> hit its yearly quota in the span of two days.  The first accident happened on Friday, when a young college student ran the red light on McClellan Circle, slamming into the side of another woman&#8217;s car, who died on impact.  The student is being charged with reckless homicide.  </p>
<p>Alcohol played a part in the second fatal crash, where a <a href="http://www.isaacsandisaacs.com/drunk-driver-accidents/" title="Drunk Driver Accidents">drunk driver</a> ran a red light on Old Lemons Mill Rd., causing another driver to hit him in his passenger side, instantly killing his 28-year old passenger.  </p>

<p>Services for Sizemore will be held at First Baptist Church of London on Tuesday.</p>
<p>The crew was on their way back to the base after transporting a patient.  The crash is still under investigation.</p>

The bulk of the money in dispute comes from work done to decontaminate and decommission a plant in Portsmouth.  </p>
<p>No one could be reached at the DOE for comment.</p>

				<content:encoded><![CDATA[<p>A 63 year old man was found dead in the lake after falling off of a fishing pier at Lake Barkley in Cadiz.  </p>
<p>Everett Pennington drove his golf cart to the pier to go fishing over Memorial Day Weekend.  After several hours, his wife went looking for him, only to find his body floating between the dock and the bank.  The drowning has been ruled as accidental.</p>

<p>The Lexington Public Library must pay $927,491 to Kathleen Imhoff, its former chief executive officer, because of the <a href="http://www.isaacsandisaacs.com/practice-areas/hourly-wage-laws/" title="Hourly Wage Laws">way it terminated her employment</a> in July 2009, an arbitration panel ruled this week.</p>
<p>The arbitrators said Imhoff had a four-year employment contract that allowed the library board of trustees to fire her for cause and not be obligated to continue paying her $137,035 annual salary and benefits.</p>
<p>However, the library board instead dismissed Imhoff without citing a cause. Her contract did not specify what her compensation would be in such an event, so the library must honor the remaining two years of her deal at a cost of $446,129 and pay damages, interest and fees totaling $481,362, the arbitrators said in their legally binding decision.</p>
<p>The case returns to Fayette Circuit Court, where Judge Thomas Clark is expected to hold a hearing on it June 7. Richard Getty, Imhoff&#8217;s attorney, said that he hopes the judge will accept the arbitrators&#8217; ruling &#8220;unless something extraordinary or strange happens.&#8221;</p>
<p>&#8220;I don&#8217;t see where there&#8217;s any grounds to do anything but enforce it,&#8221; Getty said. &#8220;From Mrs. Imhoff&#8217;s point of view, she feels vindicated after several years of struggling to get through this whole process. She wishes it had been avoidable.&#8221;</p>
<p>The library board dismissed Imhoff after the Herald-Leader detailed more than $134,000 she spent on travel, meals, gifts and other items over five years. A city audit later raised more questions about library spending and reported that 1,522 images of &#8220;adult materials&#8221; were found on a library computer assigned to Imhoff, in violation of library policy.</p>
<p>Imhoff defended her spending as proper and denied viewing adult images on the computer. Imhoff said she took the computer home with her for work duties, and someone else evidently used it to view the images without her knowledge. She also said her work office had been broken into on three occasions, allowing someone to tamper with her computer.</p>
<p>In 2010, Imhoff sued the library for more than $5 million in damages. She alleged that she was fired in violation of her contract, that she was publicly defamed by the library board chairman and that she was discriminated against because she is a woman. Clark dismissed the second and third claims but referred the first to arbitration.</p>
<p>The arbitrators said they ruled only on the legality of how Imhoff was fired, not on the circumstances surrounding her dismissal.</p>

<p>Imhoff, now 67, is unable to find professional library work because of negative publicity about her dismissal, Getty said. Of the money awarded to her in arbitration, $228,333 was &#8220;consequential damages&#8221; for lost professional opportunities. She also received $202,337 in pre-judgment interest at 8 percent a year for four years; $30,960 for diminished Social Security retirement benefits; and $19,730 for her share of the arbitration fees.</p>
<p>Getty said the library board could have avoided more than half the cost it now faces — not to mention its own legal bills — by giving Imhoff the remaining salary and benefits it owed her in 2009 when she was dismissed, as she requested before suing.</p>
<p>&#8220;It&#8217;s sort of poetic justice in a way,&#8221; Getty said. &#8220;They wouldn&#8217;t listen. They delayed and they stalled. Now they&#8217;ve lost and they&#8217;re paying the price.&#8221;</p>

				<content:encoded><![CDATA[<p>22 year old Amaris Blair and her 23 year old brother, Jonathan Blair, died on Saturday night on KY 245. </p>
<p>After losing control of her car, a 2002 Volkswagon Jetta, Amaris Blair struck a 2005 Chevy pick up truck driven by Christopher Greer.  The Blairs were pronounced dead at the scene, and Greer and his two passengers suffered <a href="http://www.isaacsandisaacs.com/drunk-driver-accidents/" title="Drunk Driver Accidents">non life-threatening injuries</a>.</p>
<p>Alcohol appears to have been a factor in the wreck, and toxicology tests are pending for both drivers.   </p>

				<content:encoded><![CDATA[<p>The United States Supreme Court declined to overturn a ruling from the Kentucky Supreme Court involving the right to sue over wrongful death claims.  </p>
<p>Beverly Enterprises, a nursing home operator in Kentucky, was sued by Donna Ping, over the <a href="http://www.isaacsandisaacs.com/practice-areas/wrongful-death/" title="Wrongful Death Attorneys">death</a> of her mother while residing at one of Beverly Enterprises&#8217;s nursing homes.   Because Ping had signed an Arbitration Agreement on behalf of her mother, Beverly argued that Ping could not bring a wrongful death suit against Beverly.  </p>
<p>The Kentucky Supreme Court concluded that Ping <em>could</em> sue Beverly for the wrongful death of her mother, as the arbitration agreement gave her power-of-attorney rights over decisions involving her mother&#8217;s healthcare and did not expressly give her the authority to sign the arbitration agreement. The Court cited several other similar decisions in other states, including Texas, in its conclusion.    </p>

				<content:encoded><![CDATA[<p>Put down your cellphone while driving. Don’t text, talk or use social media. It can wait. If you are sure that it cannot wait then pull over in a safe location before putting that phone to use.</p>
<p>Also, pay attention to your medications. If you took something that says “do not operate heavy machinery” then don’t drive. A car is heavy machinery. If you take sleep aids, then wait to drive until it is fully out of your system. For most that means a full eight hours before driving.</p>
<p>Finally, this may seem obvious, but do not drink alcohol and drive. Do not get in a car with someone who is drinking and driving. Of course, this includes recreational drugs. It is not worth your life, or worse, you taking someone else’s life.</p>
