No matter how careful you are and how hard you work to create stability and a good life for yourself and your family, a serious accident can change everything in an instant. Suddenly, you are injured and unable to work, and you’re hoping that you will receive fair compensation to help you to make ends meet in this emergency. You have paid insurance premiums scrupulously for years, and you are counting on the liable party’s insurance company as well as your own to have your back when the chips are down. Unfortunately, your hope of getting a fair deal from insurance may be unfounded.

Personal Injury Law and the Indiana Comparative Fault Rule
In Indiana, if you are found to be partly at fault in your accident your compensation will be reduced by the percentage of fault assigned to you. Most of these cases require an understanding of how negligence works. Example — You are driving down the street going five miles over the speed limit when a big refrigerated truck turns out of a grocery store parking lot and runs right into you, totaling your car and injuring you so severely you may lose a leg. Because your accident was serious, the grocery chain’s insurance carrier will send out a team of accident scene investigators right away. Their job is to reduce your personal injury claim by blaming the accident, or at least part of the accident on you. The worse you are injured, the harder they will work to find evidence to prove that you caused the accident or were at least partly responsible.
According to the Indiana comparative fault rule, if the liable party can prove that you are 51 percent responsible for causing the accident, they can deny your claim entirely. If they find you were somewhat responsible, your personal injury claim will be reduced by the percentage of responsibility assigned to you. In this case, they could find that you were 25 percent responsible for your accident because you were speeding. If they do so, your compensation will be reduced by 25 percent. This could prove to be disastrous when you are seriously injured, cannot work, and have medical bills and other financial obligations.
Isaacs & Isaacs Will Fight to Get Your Fair Compensation
Whether your personal injury was caused in a car accident, a defective medical device, a workplace injury, or by a dangerous pharmaceutical drug, we will fight to get your fair compensation from all liable parties. If necessary, we will file a personal injury lawsuit in order to obtain access to evidence and testimony to build a strong case to prove that negligence caused your injury. If you have lost a loved one because of the negligence or wrongful act of another, we will help you file a wrongful death claim.
With some personal injury cases, the cause of the accident is not readily apparent. Companies such as medical providers have been known to alter records and coach employees what to say in order to deny responsibility and liability. Isaacs & Isaacs has the resources and manpower to investigate your accident thoroughly and prove what happened to cause your injury. We are experienced negotiators and litigators, and we will not roll over for a low offer from insurance. We will demand a fair personal injury settlement to cover all your damages, including:
- Medical bills
- Lost wages
- Pain and suffering
- Property damage
There are many other damages you may be entitled to compensation for, depending on the facts of your unique situation.
How Much Could Your Personal Injury Case Be Worth?
You Don’t Owe Us Anything Unless We Get You Your Money
Isaacs & Isaacs injury attorneys will represent you on a contingency fee basis: you don’t owe us anything until and unless we get you your money. We will bear the cost of investigating the cause of your injury and proving what happened while you focus on healing. Accident victims who enlist the help of a skilled and aggressive personal injury lawyer receive many times the compensation than those who naively rely on the insurance company to offer a fair settlement, even after paying the reasonable costs of representation.
