What is Xarelto Used For?
Xarelto was developed by Janssen pharmaceutical, a division of Johnson & Johnson, as a blood thinner which could replace the commonly used blood thinner Warfarin. The advertised benefits of taking Xarelto are:
- No need for blood monitoring;
- No dietary restrictions;
- No frequent adjustments.
In 2011 the United States Food and Drug Administration (FDA) approved Xarelto to prevent Deep Vein Thrombosis for patients undergoing hip or knee replacement surgery. Later that year Xarelto gained FDA approval for stroke prevention in patients with Atrial Fibrillation (irregular heartbeat).
Xarelto indications include treating:
- Atrial Fibrillation (AFib – irregular heartbeat which could lead to stroke);
- Deep Vein Thrombosis (DVT – blood clot which forms in the leg & can travel to lungs);
- Pulmonary Embolism (PE – possibly fatal blood clots in the lung);
- Reduce the risk of blood clots after hip/knee replacement surgery.
Side Effects of Xarelto
According to the FDA label, dangerous side effects from Xarelto Blood Thinner can include:
- Forming a blood clot in the heart which can cause a stroke;
- Frequent nose bleeds;
- Bleeding gums;
- Heavy menstrual bleeding;
- Red, pink, or brown urine;
- Bright red or tar-like black stools;
- Coughing up blood/blood clots;
- Vomiting blood;
- Infection at wound sites;
- Back pain;
- Spinal blood clot which can lead to paralysis.
The label warns to talk to your doctor immediately if you are experiencing any of the above side effects.
Are Xarelto Side Effects Controllable?
The FDA label warns patients not to stop taking the drug or miss a dose as this could prove dangerous. It warns against taking too much (double dosing) and of running out before getting the prescription refilled. Patients are warned not to take Xarelto if they have any kind of abnormal bleeding, and to talk to their doctor before taking Xarelto if they have ever had:
- Bleeding problems;
- Kidney or liver problems;
- Are pregnant/planning to become pregnant;
- Are breastfeeding.
The FDA label warns patients to tell doctors/ dentists before having any kind of surgery, medical, or dental procedure. Patients are warned not to take this medication if they take certain other medications, and if they are not sure if they should take Xarelto along with other current medications, including non-prescribed medicines like aspirin, vitamins, and herbal remedies like St. John’s Wort, to ask their doctor first, before taking Xarelto.
Is There an Xarelto Antidote?
The main dangerous side effect of taking Xarelto is uncontrollable bleeding, and while Xarelto is vastly more expensive than the widely used blood thinner Warfarin which was the standard anticoagulant drug used since the 1950s, unlike Warfarin there’s no antidote for Xarelto if a patient begins to bleed out. Another dangerous side effect is that if you take Xarelto to prevent blood clots which could cause strokes and you quit taking Xarelto, you are at a much greater risk of forming the blood clots after you stop taking the drug.
Xarelto Lawsuits Continue to Mount
The first lawsuits were filed in 2014, three years after the drug gained FDA approval.
To date thousands of lawsuits have been brought against parent company Johnson & Johnson and its subsidiaries Bayer & Janssen Pharmaceutical. The lawsuits allege failure to warn patients of the dangers of taking this drug, and also that the drug itself is unreasonably dangerous because it can cause bleeding and there’s no antidote if the bleeding starts.
Many of these cases are wrongful death suits brought by family members on behalf of decedents who died from uncontrolled bleeding after taking Xarelto, without being warned of the hazards the drug poses. When you take a drug that can cause uncontrolled bleeding and there is no antidote to stop the bleeding once it starts, it can be considered unreasonably dangerous.
Xarelto Settlements Can Depend on the Type of Lawsuit
The Xarelto lawsuit cases rapidly gained MultiDistrict Litigation (MDL) status to consolidate 2,800 of the cases filed and allow a federal district judge to rule on factual issues and pretrial motions. Currently these cases have not been tried or settled, but victims continue to file cases. Allegations vary, according to the facts of each case, but include:
- Strict Product Liability (SPL):Failure to warn;
- SPL: Design Defect;
- Negligence (N): Failure to Warn;
- N: Negligent Design;
- N: Negligent Misrepresentation;
- Breach of Warranty (BOW): Breach of Express Warranty;
- BOW: Breach of Implied Warranty;
- Violation of Consumer Protection Laws;
- Wrongful Death;
- Punitive Damages (To punish wrongdoers and discourage similar behavior).
Civil litigation can take several years to settle or go to trial. Especially in mass tort actions where there may be millions of documents to go through and numerous motions to file before the trial or settlement negotiations even begin. Your attorney has little control over this process when there are thousands of cases against a defendant company such as a bad drug manufacturer.
Typically, after MDL issues are ruled on by the presiding federal judge, the cases are returned to the venues where they were filed for trial if no settlement has been reached. The stronger the evidence against the company, the more likely they will be to offer a large amount of money to settle. Trials are costly and can drag on through appeals, and nobody can predict how large an amount of money a jury may award a plaintiff who has been grievously injured by a big company’s negligence or wrongful act(s). Because of these factors most cases are settled, if the company is willing to offer plaintiffs a just sum to cover the damages they’ve suffered.
