If you or your loved one has become ill after using Roundup, we have attorneys that can help you understand whether you have standing to recover damages from Monsanto.
Glyphosate Cancer And the Lawsuit – What is Known?
Though Monsanto has aggressively advertised their Roundup products as safe to use, independent scientific testing has shown that regular exposure to Roundup and other glyphosate herbicides can cause cancer. Many farmers, agricultural workers, horticulturists, landscapers and home gardeners who used Roundup regularly have become seriously ill or have died from non-Hodgkin’s lymphoma and other illness caused by Roundup.
Two Companies Monsanto Used for Glyphosate Testing Were Convicted of Scientific Fraud
Monsanto hired Industrial Bio-Test Laboratories to conduct tests of glyphosate in order to obtain United States Environmental Protection Agency registration. Three IBT executives were convicted of scientific fraud in 1983i after a United States Food and Drug Administration inspection and an FDA audit revealed discrepancies between the testing data and toxicology reporting for glyphosate.
Craven Laboratories, another company that Monsanto used to test for Roundup registration and post-registration studies, was found guilty of data falsification.ii Monsanto claims on its website that it was a victim of the scientific fraud, along with other companies who used the labs. However, Monsanto’s subsequent behavior regarding Roundup weedkiller could lead one to conclude it only cried wolf after getting caught using dishonest labs.
Monsanto Sued by Attorney General of New York for False Claims
In 1996 the New York Attorney General sued Monsanto for making false advertising claims and forced Monsanto to stop doing so in New Yorkiv. Claims Monsanto is prohibited from using in New York State include:
- Roundup is less toxic to rats than table salt
- Monsanto herbicides are practically non-toxic to wildlife
- Roundup is biodegradable
- Roundup is safe to use on areas where kids and animals play
- Roundup does not move through the environment
- Roundup herbicide is good for the environment
- Roundup is safe and won’t harm people or the environment
Argentina’s Population Was Poisoned by Exposure to Glyphosate and Roundup Ready Soyv
In an attempt at economic recovery, Argentina’s government became a top grower and exporter of GMO soyvi. In the late 1990’s Argentina began planting GMO soybean crops. By 2009 Roundup Ready soy was planted in over half of Argentina’s agricultural land. The crops, which blanketed Argentina, were sprayed from above with glyphosate herbicide. In 2002 doctors began to report alarming health problems in the population which lived around the crops.
Common problems reported in Argentina include:
- Birth defects
- Respiratory problems
- Cancer by age 30
- Dead livestock
- Dead fish floating in streams
- Dead food crops
A Group of International Scientists Publish a Report on Genetically Modified Soy
In 2010 a group of highly respected scientists from around the world published an alarming report in GLS Bank vii.
The report summary begins by citing three GMO industry-sponsored studies which “attempt” to produce evidence to back the sustainability of soy genetically modified to tolerate Roundup glyphosate.
The report, GM Soy: Sustainable? Responsible? contends that glyphosate, especially when combined with inert ingredients found in Roundup, is highly toxic to the environment, and many if not all life forms. The report cited a study published by Argentine government scientist Dr. Andres Carrascoviii that found glyphosate herbicide causes deformities in frog and chicken embryos which are similar to those seen in humans exposed to glyphosate. The animals used in the study were exposed to smaller amounts of glyphosate than humans in agricultural areas are commonly exposed to.
The report goes on to enumerate the harms done by GMO soy, including:
- Premature births and miscarriages
- Multiple myeloma
- non-Hodgkins lymphoma
- DNA damage
The report points out that the United States Food and Drug Administration has never said that glyphosate is safe, as Monsanto and the GMO industry claims. The report contends that GMO soy has not been found safe to eat, but has caused damage to animals who were fed this food, including damage to internal organs such as the liver, reproductive organs, heart, and kidneys.
The report contends that the GMO crops give lower, not higher yields. The report states that the state of West Virginia launched an investigation in 2010 for false advertising by Monsanto, for claiming its Roundup Ready 2 soy gives higher crop yieldsix.
The report states that reliance on Monsanto Roundup gives rise to the growth of Roundup-resistant “superweeds.” These superweeds force farmers to resort to older toxic herbicides because glyphosate eventually doesn’t work at all.
The report states the Roundup soy is ruining the soil and causing farmers huge financial problems. The report states that Monsanto is restricting farmers’ access to non-GMO seeds and imposing quotas on Brazilian farmers that demand they use GMO seeds for 85 percent of their crops.
According to this report by members of the international scientific community, Monsanto is strong-arming farmers around the world and also using deceptive advertising to promote Roundup and Roundup ready seeds. Monsanto and others are promoting bogus scientific studies that back up their claims that Roundup herbicide is safe. This paper and other studies published by independent scientists worldwide amount to an outcry of alarm against Monsanto and the GMO agricultural industry for poisoning our planet and placing life forms including human in grave danger.
More Recent Scientific Studies of Glyphosate
An article published in the National Center for Biotechnology Information in 2013, entitled Glyphosate pathway to modern diseases II: Celiac, Sprue and Gluten Intolerancexcharges that Celiac disease and gluten intolerance has increased fourfold worldwide due to Roundup glyphosate saturation in our food. The disease is most evident in Western Europe and North America, where an estimated 5 percent of the population suffers from this disease.
- Skin rashes
Celiac disease is a precursor to kidney failure, reproductive issues, thyroid disease, and cancer, specifically non-Hodgkin’s lymphoma.
An article published in NCBI in 2014 entitled Non-Hodgkin Lymphoma and Occupational Exposure to Agricultural Pesticide Chemical Groups and Active Ingredients: A Systematic Review and Meta Analysisxi describes three decades of research into the effects of occupational exposure to glyphosate on agricultural workers. The paper finds that there’s a causal connection between non-Hodgkin’s lymphoma and occupational exposure to glyphosate weed killer.
The paper cites 44 independent (not GMO industry sponsored) studies done on the effects of various pesticides on workers exposed to the chemicals. The paper states that despite producing a big portion of the world’s food, low and middle-income countries were underrepresented in studies of the effects of the chemicals on the agricultural workers.
Each paper published which opposes the widespread use of glyphosate and GMO crops cites numerous independent studies done by scientists who have no monetary incentive to back Monsanto’s safety claims. Most recently, a widely publicized paper published in March 2015 by the World Health Organization’s International Agency for Research on Cancer placed glyphosate in group 2A, probably carcinogenic to humans xii.
Monsanto reacted xiii with an industry-sponsored report by the European Food Safety Authority, which was viewed with skepticism by world scientistsxiv. Reasons for skepticism on the part of the scientific community include a lack of transparency in the EFSA study which relied on “anonymous officials and undisclosed studies”xv.
Nationwide Lawsuits Against Monsanto
Monsanto has continued to do all it can to discredit independent scientific studies that challenge its assertion that glyphosate is safe. However, its EFSA report didn’t work like it was supposed to in discrediting the IARC study because the lack of transparency cast skepticism on the results. Further, the IARC study it tried to discredit has alerted people that their cancer was caused by Roundup weed killer. Regular people believed Monsanto’s extremely persuasive false advertising and used its product for decades, some even after being diagnosed with non-Hodgkin’s lymphoma. Cancer victims have filed lawsuits across the United States or their survivors have filed suits demanding compensation including punitive damages.
Complaints allege that Monsanto has launched a 40-year campaign of misinformation which caused people to trust that their Roundup products are safe. Monsanto claims that their herbicide and GMO seeds are safe despite overwhelming scientific evidence to the contrary. They have done all they can to discredit scientific studies that show evidence of the toxicity of glyphosate herbicide. They are pressuring farming communities who are suffering serious injuries from the toxic effects of glyphosate and GMO crops to continue to use these toxic products. Because of the grave injury done to humans, wildlife and our planet in worldwide farming communities and also in urban populations we must conclude the behavior of this company is nothing short of evil.
