Speeding Down the Highway in a Gigantic Truck is Deadly

You have heard it said that “speed kills”, but when you combine a very, very large truck with speed, you have a killer combination. Let’s face it, a large tractor-trailer on a busy interstate is cause for concern when you are on the road with your family. It’s even worse when they are flying down the highway just to get to their next stop. And speeding truckers are a national safety problem for the rest of us.

Speeding 444

According to Federal Motor Carrier Safety Administration statistics for 2015, one of the most frequent commercial truck driver violations in roadside inspections was speeding. Here are the 2015 numbers for truckers who were caught violating speed limit laws:

  • 6-10 miles over the speed limit: 62,103
  • 11-14 miles over the speed limit: 23,581
  • 15 or more miles over speed limit 13,945

These statistics are for large trucks with a Gross Vehicle Weight Rating (GVWR) of 10,000 pounds or more, and/or trucks of any size that carry hazardous materials.

Keep in mind, these statistics reflect the number of truckers who were caught, usually a small percentage compared to what’s really going on out there. It is no wonder we have a high number of injuries and fatalities in crashes with large commercial trucks.

There were 476,000 crashes involving large trucks and buses in 2014. Of this number, 93,000 caused injuries and 3,649 were fatal. Of the fatal crashes, large trucks were involved in 3,424 crashes, buses, 225.

Mandating a Truck Speed Limit Governor For Public Safety

Big trucks weighing 10,000 pounds or more cannot stop, respond or maneuver like smaller vehicles. Because of the climbing rate of trucking accidents causing serious injury and death with property damage of billions of dollars each year, the National Highway Safety Traffic Administration and the FMCSA submitted a rule to the White House Office of Management and Budget for approval.

The rule would make speed governors for trucks weighing over 26,000 pounds mandatory. What a speed governor does is monitor the truck’s speed by a computer, and communicate with the engine to slow the truck down if it exceeds a speed limit deemed safe.

There are many online articles and YouTube videos instructing truckers on how to raise the speed limit on speed governors, or disable them completely. This alone is alarming evidence that many drivers of these gigantic commercial trucks do not want to comply with speed limit laws.

The rule was submitted on May 19, 2015, and was expected to be published (enacted as law) that August. The Owner-Operators Independent Drivers Association, which provides insurance to truckers and trucking companies, opposed the rule, saying that if trucks could not drive with the flow of traffic it would be hazardous. In September 2015 the White House OMB announced publication of the rule would be delayed, giving no explanation. The rule has yet to be enacted.

The Cost of Truckers’ Refusal to Comply with Speeding Laws

The terrible cost in injuries, fatalities and property damage that lawless truckers impose on the rest of us will continue to rise. Regardless of who was wrong, the insurance companies who back these rogue truckers will continue to do all they can to pay as little as possible to accident victims.

Though nothing can make up for the horror, trauma and injury of being in a collision with a gigantic, out of control death machine, or bring back your loved one who was killed in a horrific truck accident, you can demand justice through civil litigation to obtain financial compensation from the trucking and insurance companies to pay for your harms, losses and damages. Although money is no substitute for a permanent physical disability or loss of a loved one, it does help by making the wrongdoers pay for the hurt and the harm they caused by their carelessness and provide for your financial needs caused by the wrongdoer and the survivors’ financial loss when a loved one is torn from their lives.

Truck Insurance Companies Respond Rapidly to Trucking Accidents

If you or a loved one was hurt or killed in a trucking accident, the trucking industry insurance companies will fight hard to withhold every penny they can to compensate you for your loss. As soon as an accident involving a big truck occurs they send a team of accident investigators out, and these people are not going there just to find out what happened; they are going there to try and minimize the cost of your claim, or to gather evidence to place the blame for the accident on you.

The primary goal of the insurance companies and their investigators is to financially protect their insureds, the trucking company and driver). Paying you the least amount they can is their job.

Just remember the insurance adjusters are not there to help you, but rather their goal is to find out how they can pay you the least amount they can to make your claim go away. Nothing you can say or do will deter or stop them from their mission of paying little or nothing at all to settle your claim. Therefore, do not speak to anybody but police and medical personnel. If you possibly can, call a Trucking Accident Law Firm immediately, or as soon as possible. This will allow you to redirect questions to your attorney.
